1. Services & Project Scope

Pixalty provides custom WordPress web development, brand identity design, UI/UX prototyping, vector illustration, site maintenance, and digital tools (including the KODO Plugin Series).

  • Detailed Proposals: Every client project is governed by a individual project proposal or agreement detailing line-item deliverables, timelines, and costs.
  • Scope Creep: Any revisions, features, or requests outside the originally agreed project scope will require a separate written estimate or hourly rate adjustments.

2. Intellectual Property Rights

  • Pixalty Intellectual Property: All content on this website—including website layout designs, custom graphics, logo marks, text copy, vector artwork, and code scripts—is owned by or licensed to Pixalty and protected by copyright and intellectual property laws.
  • Client Deliverables: Upon full and final payment of all project fees, full rights and ownership of completed custom deliverables (such as custom logo vector files, custom website graphics, and custom code) are transferred to the client.
  • Portfolio & Self-Promotion: Unless explicitly restricted by a signed Non-Disclosure Agreement (NDA), Pixalty reserves the right to display completed project designs, site layouts, and case studies in our public portfolio (https://pixalty.com/projects), social media channels, and promotional materials.

3. Payment Terms & Third-Party Contracts

  • Direct Billing: Standard direct client engagements require a 50% non-refundable deposit prior to project commencement, with the remaining 50% due upon project completion prior to final website deployment, domain transfer, or source file release.
  • Upwork Engagements: Clients who choose to initiate contracts via Upwork are subject to Upwork’s Terms of Service and Escrow Payment Terms. Milestone releases occur upon delivery and approval of agreed work phases.
  • Subscriptions & Software: Fees for ongoing site maintenance, domain registrations, or third-party premium plugins/hosting are the sole responsibility of the client unless explicitly bundled into a service agreement.

4. Client Responsibilities & Content Approvals

To maintain project schedules, clients agree to:

  • Provide clear branding assets, copy text, images, and necessary access credentials (hosting, domain registrars, WordPress administrative logins) in a timely manner.
  • Provide consolidated feedback during designated design and revision stages.
  • Warrant that all text, images, trademarks, and media supplied to Pixalty are owned by the client or properly licensed. Pixalty assumes no liability for copyright infringement caused by client-supplied media.

5. Website Maintenance & Performance Disclaimer

While Pixalty builds custom WordPress sites optimized for high performance, Core Web Vitals compliance, and security:

  • Third-Party Modifications: Pixalty is not responsible for site errors, layout breaks, or performance drops resulting from third-party plugin updates, theme modifications, or server/hosting changes made by the client or external third parties after project handoff.
  • Uptime Guarantee: Pixalty does not host websites directly and is not liable for hosting server outages, downtime, or domain renewal lapses managed by third-party hosting providers.

6. Free & Premium Plugins (KODO Series)

  • All free or downloadable WordPress plugins provided on https://pixalty.com/free-wp-plugins/ are provided “as is” without warranty of any kind.
  • You are licensed to use Pixalty plugins on your personal or commercial websites, but you may not redistribute, resell, or claim original ownership of un-modified plugin source code.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Pixalty and its founder, Sampath, shall not be liable for any indirect, incidental, consequential, or punitive damages—including loss of profits, data, or business interruption—arising from the use of our website, services, or digital products.

8. External Links

Our website may contain links to third-party platforms (such as client live sites, Behance, Dribbble, or Upwork). Pixalty has no control over and assumes no responsibility for the content, privacy practices, or accuracy of any third-party websites.

9. Modifications to These Terms
